State Powers
The Florida State Constitution, like the constitutions of all other states, offers a framework for running the state and protecting the rights of its residents. While the Bill of Rights in the United States Constitution provides certain rights to all citizens, the Florida State Constitution also has similar provisions that safeguard individual liberty. One may better comprehend how the state constitution is similar and differs from the federal constitution by comparing the guiding principles set forth in each document. In this paper, three sections of the Florida State Constitution that align with the Bill of Rights in the United States Constitution will be compared and contrasted.
Firstly, the protection of free speech and the press in Section 4, Article 1 of the Florida state constitution is similar to that in the First Amendment. Florida's constitution acknowledges that the government cannot restrict a person's right to express oneself by speech, writing, or other methods, much like the U.S. Constitution does (D'Alemberte, 2017). But the Florida Constitution goes further the First Amendment by stating categorically that everyone has the right to be "free from government restraint" when they publish or express their thoughts.
